Huffman Riley Kao PLLC is a law firm that specializes in assisting clients to comply with the U.S. export laws while facilitating business.

 
The U.S. export and import laws impact all aspects of business, from the highly regulated defense industry governed by the International Traffic in Arms Regulations (ITAR) to the more commercial nature of the Export Administration Regulations (EAR).  Nearly any conceivable transaction may be controlled by the Office of Foreign Assets Control (OFAC), and the regulations administered by U.S. Customs and Border Protection (CBP) keep an eye on all items entering or exiting the United States.
 
We bring a wealth of experience in areas including:
  • ITAR Compliance - The ITAR of the U.S. Department of State govern defense articles and related technical data and defense services as well as certain commercial items that have been determined to have a significant military use, such as commercial communications satellites.  Intangible transfers of data and services, whether in hardcopy, or electronically transferred by fax, e-mail, or voice, constitute exports under the ITAR and are increasingly the foucs of enforcement actions by the U.S. Government.
  • EAR Compliance - The EAR of the U.S. Department of Commerce govern nearly all commercial and dual-use items.  Dual-use items are items that have both commerical and military application.
  • OFAC Compliance - The OFAC regulations of the U.S. Department of Treasury create requirements that govern all transactions with certain destinations or entities.  From trade embargoes to more targeted limitations, the OFAC regulations are an extensive body of law that can have a significant impact on entities in the United States and abroad, including businessess with foreign subsidiaries and branches that maybe subject to foreign lawas as well.
  • Related Areas - Our attorneys also assist clients with matters involving: U.S. Customs and Border Protection, such as seized shipments and country of origin marking; the Federal Acquisition Regulation (FAR) and Defense Federal Acquisition Regulation Supplement (DFARS); and conducting the necessary due diligence in connection with mergers, acquisitions, and divestitures involving government contracts to assess potential compliance risks and liabilities.
